Buying spanish property through a company: It is possible to purchase real estate in Spain with a foreign registered company. The owner of the real estate is therefore effectively the company. However, we will have to start a specific procedure for this, to first give legal validity in Spain to your foreign registered company. This procedure is in addition to the normal purchase procedure for property in Spain and also applies to the purchase of new construction in Spain or to the purchase of bank repossessions in Spain.

Buying spanish property through a company: Documents

In other words, your company must be provided with a Spanish VAT number and will also have a number of obligations each year. We will also ensure that your company is equipped with the Clave Digital, which is indispensable to meet the necessary tax obligations and to communicate with the Spanish tax authorities.

Why can it be interesting to buy Spanish property with a company? If, for private reasons, you do not want the property registered in your name in Spain, or if the funds for the purchase are already in your company and you do not wish to remove them from your company, it is interesting to buying real estate with a company that is registered abroad.

For this we will need the following:

  • Spanish NIE of the owners/administrators

  • Deed/Articles of incorporation of the company. This document must be provided with an apostille and will have to be translated by a sworn translator (we can arrange this for you).

  • Certificate/excerpt from the Commercial Register showing who the administrators and/or owners are, registered office and VAT number. This document must be provided with an apostille and will have to be translated by a sworn translator (we can arrange this for you).

  • Evidence of valid reason for this request. We provide this by delivering a copy of the purchase contract to the Spanish tax administration.

  • Power of attorney from the owners/administrators to arrange the entire procedure. We will prepare this power of attorney for you so that you only need to sign it at your notary public. This way we can arrange everything for you remotely and you do not have to worry.
